Protecting the rights of women

Posted on 07 May 2009

Islam has granted woman full rights as may be necessary to build a happy and peaceful life. But he woman of Bangladesh is often subjected to injustice in their family lives and in the society although Islam gives them equal status of a man- (Ref: Verse No.3/191). It has been observed that they cannot take their meals before the male members of the families do that or have no say in the taking of any decision in family matter. It has also been frequently found that a woman is abused for giving birth a female child or for remaining childless.
On blaming woman for giving birth daughter(s) or for remaining barren, the Quran says, “Allah’s is the kingdom of heavens and earth. He creates what He pleases. He grants to whom He pleases daughters and He grants to whom He pleases sons,”-42/49. Again Allah says, “Or He makes them of both sorts, male and female; and He makes whom he pleases barren,”-42/50.

In terms of these two verses, blaming woman for giving birth daughter or
for remaining childless is against the ordinance of Allah and whoso does it is liable to punishment. But sadly the teachings of the Quran have been forsaken in our society. There is none to voice against this sortof injustice done to woman. Those who claim themselves champions in safeguarding the interests of Islam do not give lectures on this issue in the mosques or in the waz-mahfi I or in the public meeting.

Once I asked a imam of a mosque why don’t you give lecture in your Friday
congregation about the safeguarding of woman’s rights in Islam or about the verses concerning science and technology? His reply was not satisfactory.

Another means of torturing woman is dowry. After marriage, husband(s) and his/their relations press his/their wives to bring money from their fathers. In case of failure, they are inhumanly tortured to death, or divorced labeling scandal. On the other hand, many parents cannot marry their daughters, as they are unable to give dowry in cash or kinds. In such situation, the generous people should extend their supports to’ the poor parents but they do not. On the other hand, scandalmongers spread scandal about the marriageable girls to seal their future because we live in such a society where it is very difficult to marry a girl having scandal whether true or untrue.

On
dowry the Quran says, “Give women their dowries as a free gift,” -4/4. By this verse we learn that Allah has legalised dowry to wives by husbands, meaning that it is unlawful if a husband demands something, cash or kind, from his wife. In such case, he (and his accomplices) are liable to punishment. It is a great atrocity to go against the ordinance of Allah. Naturally a question arises why don’t the Islamic scholars and the imams of mosques try to make men aware of the dire consequences for going against the Quran and Islam?

There is law in the land, prohibiting dowry to husband by wife. But it is not
enough. The State must make such law as giving severe punishment to the husband(s) and his/their aides and to monitor the application of the law. The third transport of injustice to women is depriving them from the shares of their parents, children and husbands. One day I saw one of my sisters in sad mood. Being asked to state the reason, she said, “I have no male child but two daughters. Now I hear that they will not inherit the properties of their father.” I said, “This is wrong. Read the verse numbers .4/11, 12 and 176 and there you will find that their shares are safeguarded.” I explained that in event of death of a man or a woman and he or she leaves behind two daughters but no son, they would inherit two-thirds of their parents’ whole properties. The deceased’s parents will get each one-sixth while the spouse will get onefourth in case of husband and one-eighth in case of wife. If the
deceased has one daughter, she will receive half of the total properties.

Another case is that a husband has warned his wife that she will not be part of his properties after his death. It is his son born to his first wife will get everything he will leave. For fearing of getting divorced, the wife did not protest yet. . In such situation, the State must come forward to protect them and their rights in properties.
